  • This form is to grant permission to allow your child to participate in a boxing fitness class. The session will focus on teaching the basic punches, guard and stance. This is a strictly non-contact class.

    This form must be signed and completed for your child to take part.

    If you have more than one child taking part, separate forms must be filled out for each participant.

  • I (Name), (parent/guardian) fully understand that my child is responsible for monitoring their physical condition throughout the fitness/boxing training session at Boxing, Bars & Bells. I understand that the involvement of any physical activity will increase the workload of my child’s cardio-respiratory system and I accept that their reaction to the training cannot be predicted with complete accuracy and that there is a risk that adverse effects may be experienced during, or after, participation in fitness/boxing training, including abnormalities of heart rate and/or blood pressure, etc. and in extreme circumstances, death. Should any unusual symptoms occur, your child must immediately:

    a) refrain from participation in the activity
    b) inform James Toff of the symptoms experienced.

    (These points will be explained in full to your child before the training session commences).

    I accept that my child, entering into any activity on the premises of Reynolds House, Church Road, Lingfield, RH7 6AH, and/or in the outside spaces fall entirely under my (parent/guardian) consent. I understand that my child, using any form of training equipment such as punch bags, TRX, battle ropes, kettlebells, barbells, dumbbell bells, slam balls and resistance bands can be extremely dangerous and in the absence of negligence on the part of James Toff, I will hold blameless James Toff for loss or damages resulting from, but not limited to, death or injury incurred during or arising from any activity undertaken on the premises of Reynolds House, Church Road, Lingfield, RH7 6AH and in the outside spaces whilst training under the guidance of James Toff.

    I understand that I must inform James Toff of any subsequent changes to the information originally provided about my child in this Questionnaire including emergency contact details.

    I fully understand and agree that my child will not train under the influence of alcohol, recreational drugs, or any medication that could cause drowsiness and/or impair senses.

    I will also advise James Toff of any medication my child is taking at the time of training at Boxing, Bars & Bells after my child’s General Practitioner has permitted participation in exercise.

    I confirm that I have read this form in its entirety and understand the dangers and risks of fitness/boxing training before granting permission for my child to take part in sessions conducted by James Toff at Boxing, Bars & Bells.

    Signing this document confirms my acceptance of the terms and that I comply with this disclaimer.

    If you have answered 'yes' on behalf of your child to any questions in the medical section of the health questionnaire, you may need to provide a letter from your GP before your child can take part in training at Boxing, Bars & Bells.
  • 4. Terms & Conditions

  • These and conditions will apply to you once you have agreed and confirmed a session.

    You are advised to pay special attention to the provisions related to cancellation, lateness, fees and liability.

    1. My Obligations

    1.1 I will use my skills and knowledge to design a safe programme of exercise that will take into account your personal goals, fitness levels, likes and dislikes related to exercise. I will provide the coaching, advice and support to help you achieve your goals. I will advise if your goals are unrealistic or unattainable. I will maintain a professional attitude and manner throughout every session.

    2. The Client’s Obligations

    2.1 All clients must be over 16 years of age. Any information, written or verbal, provided by the client will be kept strictly private and confidential. If I require further medical information from a practitioner, the client must provide such details.

    2.2 It is understood between the client and myself that both must commit to any programme set and provide honest and appropriate feedback in order to achieve results.

    2.3 The client is required to arrive punctually for each training session so that a full session can be undertaken on each visit.

    2.4 The client is required to wear appropriate clothing and footwear.

    2.5 The client is required to warm up sufficiently if they have been taught an appropriate warm up.

    3. Health Screening

    3.1 All clients must provide the necessary information required to achieve goals such as a food diary.

    3.2 I may require a letter of ‘medical clearance’ from your GP if certain information has been disclosed in your medical history questionnaire. Please be aware that your GP may charge a fee for providing this letter.

    3.3 I cannot be held liable in any way for any injuries or illness experience pursuant to undisclosed or unknown medical conditions. All clients must immediately notify me of any changes to their medical information should their health change.

    4. Cancellation Policy

    4.1 24 hours’ notice of cancellation is required from the client for all appointments.

    4.2 Notice of less than 24 hours will incur full payment of the session fee and loss of the session. If I need to rearrange your session due to my own illness or circumstance, your next appointment will be free of charge.

    5.Rearranging a session

    5.1 At least 24 hours’ notice is required from the client to rearrange a session; which will be subject to availability. If I am unable to rearrange the session at the time you require, you must either schedule for an alternative time, keep the existing the session or cancel.

    5.2 If I need to rearrange a session I will give you at least 24 hours’ notice. In the event of the client not being able to rearrange your next session will be free of charge.

    6. Payment terms

    6.1 You will be invoiced on the last working day of each month for all sessions completed in that calendar month.

    6.2 Payments must be made via bank transfer. Full account details for payments are provided at the top of your invoice.

    6.2.1 Payment must be made within seven days of the invoice date

    6.2.2 If payment is not received within seven days a £5 administration fee will be charged

    6.2.3 If payment is not received within 21 days a £10 administration fee will be charged.

    7. Serious illness or injury

    7.1 In the event of serious illness or injury you will only be able to recommence training when you are certified as fit and ready and once documentation from a medical professional has been provided at my request.

    8. Lateness Policy

    8.1 If the client is late for a session the session cannot be extended and will end at the appointed time.

    8.2 If I am late additional time will be added to the session or to subsequent sessions if possible. If I am late due to travel or other circumstances, the equivalent monetary value in time missed will be deducted from your next invoice.

    8.3 If the client arrives more than 15 minutes late for a scheduled appointment, I may leave the premises and the appointment will be logged as a cancelation and payable in full.

    9. Contact

    9.1 You may contact me with general questions relating to your goals as often as needed via text, telephone or e-mail. I will respond as soon as possible, usually within 24 hours but this maybe longer if circumstances dictate. I kindly request that no phone calls be made after 8pm. Any contact made after 8pm or on a scheduled day off, will not be responded to until the following day.

    10. Liability

    10.1 You accept that participating in exercise has a risk of causing injury, both minor and potentially major and possibly death.

    11. Miscellaneous

    11.1 I may amend these terms and conditions from time to time without notice. All sessions, packages and purchases made from the date that the amended terms are dated, will be governed by those new terms. I will inform you if any new terms affect any current bookings you may have.

    11.2These terms and conditions shall apply when you make a booking. They shall supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) whether oral or in writing. It is advised that you print off and keep safe a copy of these terms and conditions.

    11.3 You are advised to read (and are responsible for reading) and understand all information fully.

    11.4 Any gestures of goodwill are purely that and will not form any part of any legal agreement/contract.

    I understand that I have read this form in its entirety before undertaking my first session or when requested by James Toff and accept full responsibility for my own health/well being during all training participation with James Toff. By checking

    The Compound Club Ltd, trading as ‘Boxing, Bars & Bells’ (us, our, and/or we) Co Reg 8936456 is committed to protecting and respecting your privacy.

    This privacy policy (Policy) is compliant with the requirements of the Data Protection Act 2018 (Act)
    Please be aware that except to the extent required by law, or when it is deemed impracticable to do so, you have the option of remaining anonymous, or using a pseudonym, when dealing with us in relation to a particular matter.

    1. SCOPE OF POLICY
    This Policy applies to all information or opinion about an identified individual or an individual who is reasonably identifiable (you), whether the information or opinion is true or not, and whether the information is recorded in a material form or not (Personal Information) that is collected, stored, used and disclosed by us.
    In this policy, we explain the kinds of Personal Information we collect, how and why we collect and use it, and what controls you have over our use of it.
    Please read the following carefully to understand our practices regarding the collection and use of your Personal Information.

    2. PERSONAL INFORMATION THAT MY TRAINER ONLINE COLLECTS AND HOLDS
    The Personal Information collected, held, used and disclosed by us includes, but is not limited to, the following information about you:
    • name and/or username;
    • date of birth (see section 3 below);
    • gender;
    • country of residence;
    • email address;
    • medical/health information (see section 3 below);
    • a record of pages you visit on the Boxing, Bars & Bells website;
    • information about any complaints you may lodge; and
    • information about or related to your customised training programme, support provided to you by our coaches or any other service we provide you.
    Some of the above information may also be classified as “health information” under the Act. Please see section 3 below for details about how we might collect, hold, use or disclose health information about you.

    3. HEALTH INFORMATION AND SENSITIVE PERSONAL INFORMATION
    Given the nature of our business as providers of online fitness resources, we may also collect some sensitive information about you, for example, information about your health, which is afforded a higher level of privacy protection.
    The Act includes the following information as “health information”:
    • information or an opinion about the health (including illness, disability or injury) of an individual);
    • the individual’s expressed wishes about the future provisions of health services provided to him or her; or
    • personal information which is collect as part of providing a “health service”, collectively, ‘Health Information’.
    Under the Act, a “health service” includes (among other things) any activity intended or claimed to assess, maintain or improve an individual’s health, or to record the individual’s health for the improving or managing the individual’s health.
    Health Information which we might collect about you includes, but is not limited to:
    • any medical issues (as may be relevant to your use of services we provide to you);
    • your health situation (for example, whether you are injured, pregnant or disabled, to the extent relevant to your use of the services we provide to you);
    • your current height, weight and Bodyfat percentage;
    • what facilities or equipment you use to train;
    • training frequency;
    • training experience;
    • progress management – a weekly photo of you, and record of height, weight, and similar information, as you work towards your goals through our programme;
    • progress management – a record of your progress in weekly exercises;
    • your daily calorie requirements calculated using the calorie calculator on our website;
    • your specific nutritional requirements;
    • a description of your fitness and nutrition goals;
    • activity data such as steps; and
    • any other information required for the provision of our programmes to you.
    We will not collect, use or disclose any of your Health Information except to the extent necessary to provide a health service to you through our programmes, and will ensure that any Health Information is collected, used and disclosed only in accordance with rules established by other competent health or medical bodies (where applicable) that deal with obligations of professional confidentiality.

    4. HOW THE COMPOUND CLUB COLLECTS AND HOLDS PERSONAL INFORMATION
    We will only collect Personal Information from you directly unless it is unreasonable and impractical to do so.
    We may collect Personal Information from you directly in the following ways:
    • if you subscribe to a membership with The Compound Club or create an account on our website;
    • if you request assistance or advice from our online coaches;
    • if you make a request for support online, by email or by telephone;
    • if you participate in promotional offers;
    • if you choose to subscribe to our mailing list; or
    • if you disclose information such as contact details via our website.
    In a situation where it is unreasonable or impractical to obtain Personal Information from you directly, you may be asked to consent to our collection of your Personal Information from a third party.
    We will always notify you after any of your Personal Information has been collected by us from a third party.
    We use a third party application PT Distinction which also holds your Personal Information. Their privacy policy can be found here.
    Both the Compound Club and PT Distinction comply with the following reasonable steps to:
    • protect your Personal Information from misuse, interference and loss and from unauthorised access, modification or disclosure;
    • ensure that our system is appropriately backed up to prevent the loss of your Personal Information; and
    • destroy or de-identify Personal Information when it is no longer required.
    Some security measures that we have in place to protect your Personal Information include the following:
    • access to the database where your personal information is stored is restricted to particular authorised staff members;
    • the password for database access is changed frequently;
    • we use well-known and widely used development technology to run and maintain our website; and
    • our hosting providers manage the server and database protection in accordance with standard web practices.
    In the case that any of the Personal Information held by us is lost, or subjected to unauthorised access, modification, disclosure or other misuse or interference, we will notify you immediately and advise you of the steps you should take in response to the breach. Additionally, if we receive any unsolicited Personal Information (i.e. we inadvertently obtain information about you that we did not request) we will determine whether we would have been able to obtain the information by the methods described in this Section 4. If not, we will, as soon as practicable, destroy the information and ensure that the information is de-identified.

    5. THE PURPOSE FOR WHICH THE COMPOUND CLUB COLLECTS, HOLDS, USES AND DISCLOSES PERSONAL INFORMATION
    Personal Information which is collected by us will be held, used and disclosed by us for the primary purpose of providing training and fitness regimes to our customers including:
    • personalising our fitness regimes to help you achieve your individual fitness goals;
    • formulating our fitness programmes to suit your individual health requirements;
    • providing you with the tools necessary to determine your nutritional requirements and track your food intake;
    • notifying you of account activity or update (such as a completed training programme, group comment or weekly check-ins);
    • sending you an email to notify you of any account changes or updates to our services (such as coach updates to our user programmes, training group comments, or weekly check-ins);
    • supporting and enhancing our relationship with you (this includes processing your membership subscription, providing you with better support and service and sharing company news and information with you);
    • to provide insights into the progress and experiences of The Compound Club; and
    • to deal with complaints.
    We may also disclose personal information to the extent required or authorised by applicable law, but otherwise will never do so without your consent or otherwise as expressly provided for in this Privacy Policy.
    We do not sell any of your Personal Information to third parties.

    6. CONSEQUENCES IF ALL OR SOME PERSONAL INFORMATION IS NOT COLLECTED
    You do not have to provide us with any Personal Information. However, if you choose to withhold any requested information, you may not be able to utilise our full offering, access special promotions or we may not be able to provide you with personalised support that is dependent upon the collection of such information.

    7. HOW LONG YOUR PERSONAL INFORMATION IS RETAINED
    We will only retain your Personal Information for as long as necessary to provide our services (as described in section 5 above) to you.

    8. ACCESS AND CORRECTION OF PERSONAL INFORMATION
    You have a right to request access to your Personal Information and to request its correction, by emailing us at hitmeback@thecompoundclub.co.uk or by otherwise sending your request to the address specified in section 10 below. Upon receipt of a written request from you, we will give you access to the Personal Information we hold about you within 30 days of receiving your request unless an exception to access applies under the Act.
    Upon receipt of a written request from you we will comply with our obligations under the Act to correct, amend, delete or cease to deal with any Personal Information we hold about you if it proves to be factually inaccurate, incomplete, or irrelevant to the purpose(s) for which it is being held within 30 days.

    9. COMPLAINTS PROCESS
    If you have a complaint about the way we have dealt with your Personal Information please make a complaint in writing to James Toff, director of The Compound Club Ltd whose details are included in section 10 below. We will respond to all complaints within 30 days.
    Please note that you may lodge your complaint anonymously. However, this may limit our ability to deal with your complaint and implement a satisfactory remedy.
