1.                  These Terms and Conditions

1.1                What these terms cover

These are the terms and conditions on which we will supply services to you. These services are health and fitness training and coaching services, delivered either face to face or online. You are advised to pay special attention to the provisions related to cancellation, lateness, fees and liability.

1.2                Why you should read them

These terms tell you who we are, how we will provide services to you, how you and we may change or end the agreement, what to do if there is a problem and other important information. If you think there is a mistake in these terms, please contact us to discuss.

2.                  Information about us and how to contact us

2.1                Who we are

We are the Compound Club Ltd a company registered in England and Wales. Our company registration number is 08936456 and our registered office is at 5 Town Hill, Lingfield, Surrey RH7 6AG.

2.2                How to contact us

2.3                How we may contact you

(a)                 If we have to contact you, we will do so by telephone or by writing to you at the email address you have provided to us.

(b)                 You may contact us with general questions relating to your goals as often as needed via text, telephone or email. We will respond as soon as possible, usually within 24 hours, but this may be longer if circumstances dictate. We kindly request that no phone calls are made after 20:00. We will not respond to any contact made after 20:00 or on a scheduled day off until the following day.

3.                  Providing the services

3.1                 Services

Services include: online coaching; online group exercise; telephone/zoom coaching; personal training; exercise programme design; exercise nutrition and lifestyle advice; mobile application usage.

3.2                Delivery (exercise)

We will use our skills and knowledge to design and deliver a safe programme of exercise that will take into account your personal goals, fitness levels, likes and dislikes related to exercise. We will provide the coaching, advice and support to help you achieve your goals. We will advise if your goals are unrealistic or unattainable. We will maintain a professional attitude and manner throughout every session.

3.3                Delivery (nutrition)

We are committed to helping clients achieve their ideal body composition targets relevant to their goals and within safe ranges set out by the NHS and the American Council on Exercise. Advice on nutrition, daily calorie intake, macronutrient ratios, supplements and any other diet related advice will be provided in conjunction with study-based evidence. It will ultimately be your decision which course of action to take.

3.3                Coaching

https://www.thecompoundclub.co.uk and are meant to help you identify areas in your life and your mindset which might be preventing you from moving forward and experiencing greater wellbeing.

3.5                Coaching schedule

3.6                The coaching schedule will be arranged between us and the client and can be booked up to three months in advance. We will recommend the frequency of coaching sessions based on an assessment of the client’s requirements. These will typically take place weekly. Any recommendation can be adjusted or altered throughout the coaching schedule in accordance with the terms of this agreement and the availability of your coach.

3.7                Format of coaching sessions

3.8                Coaching will take place face to face (venue by mutual agreement), via zoom, telephone coaching sessions (client calls coach) or such other format as may be agreed. We are responsible for ensuring availability for consultation at agreed times. The length of each session will be as agreed between us and the client before the coaching sessions commence (typically 30 minutes). Sessions can only be rearranged in accordance with the section in these terms and conditions headed “Rearranging Sessions”.

4.                  Client Obligations

4.1                All clients must be over 16 years of age. Any information, written or verbal, provided by the client will be kept strictly private and confidential. If we require further medical information from a practitioner, the client must provide such details. If you do not give us the information within a reasonable time of us asking for it, or if you give us incomplete or inaccurate information, we may either end this agreement or make an additional charge to compensate us for any extra work that we are required to undertake.

4.2                Commitment

It is understood between us and the client that both must commit to the programme 100% in order to achieve results.

4.3                Personal training

The client is required to arrive punctually for each training session so that a full session can be undertaken on each visit. The client is required to wear appropriate clothing and footwear.

4.4                The client is required to warm up sufficiently if they have been taught an appropriate warm up. If you are not sure of any of the warm up exercises that have been assigned it is your responsibility to notify your coach.

5.                  Health Screening

5.1                All clients must provide the necessary information required by filling out the questionnaire at https://www.thecompoundclub.co.uk/med-terms/med-terms-form/. Should your health alter in any way after you have completed this form you must notify us immediately by calling us on 07973 394 890, emailing us jamie@thecompoundclub.co.uk or re-submit this medical form including the alterations to your health.

5.2                Medical clearance

We may require a letter of ‘medical clearance’ from your GP if certain information has been disclosed in your medical history questionnaire. Please be aware that your GP may charge a fee for providing this letter.

5.3                Liability

We cannot be held liable in any way for any injuries or illness experienced pursuant to undisclosed or unknown medical conditions. All clients must immediately notify us of any changes to their medical information should their health change.

6.                  Cancellation/Rearrangement

6.1                Notice

If a client needs to cancel or rearrange a coaching or training session at least 24 hours’ notice is required from the client. Rearrangement will be subject to availability. If we are unable to reschedule for the time the client requires an alternative time must be found, the existing slot can be kept, or the client must cancel.

6.2                No refunds

No refund will be given to clients for unused coaching or training sessions unless 24 hours’ notice has been given.

In exceptional circumstances, we may need to rearrange or cancel a session. In those instances, we will also give the client 24 hours’ notice where practical. If it is not practical the next session will be free of charge.

7.                  Payment terms

7.1                Coaching

Fees are payable monthly in advance for coaching sessions. You will be invoiced on the last working day of the previous month.

7.2                Personal training

(a)                 You will be invoiced on the last working day of each month for all sessions completed in that calendar month.

(b)                 Payments must be made via bank transfer within seven days of receipt of invoice. Full account details for payments are provided at the top of the invoice.

(c)                 Where payment is not received within twenty one days a £10 administration fee will be charged.

8.                  Serious illness or injury

In the event of serious illness or injury, the client will only be able to recommence training once certified as fit and ready and when documentation from a medical professional has been provided at our request.

9.                  Lateness Policy

9.1                If the client is late for a session, the session cannot be extended and will end at the allotted time.

9.2                If we are late, additional time will be added to the session or to subsequent sessions if possible. If we are late due to travel or other circumstances, the equivalent monetary value in time missed will be deducted from your next invoice.

9.3                If the client arrives more than 15 minutes late for a scheduled session, we may leave the premises and the appointment will be logged as a cancellation and payable in full.

10.                liability and disclaimer nutrition

10.1              All information presented for nutrition is intended for informational purposes only. You should not rely on this information as a substitute for, nor does it replace professional medical advice, diagnosis, or treatment. If you have any concerns or questions about your health, you should always consult with a physician or other healthcare professional before starting an exercise and/or diet programme.

10.2              We are not nutritionists or registered dieticians. Information presented to you or stated on our website has not been evaluated or approved by the Medicines and Healthcare Products Regulatory Agency (MHRA). You are ultimately responsible for all decisions pertaining to your health. Each individual’s dietary needs and restrictions are unique to the individual. The client assumes full responsibility for consulting with a physician or other healthcare professional before starting an exercise and/or diet programme.

10.3              We are not responsible for adverse reactions, effects or consequences resulting from the use of training programmes, recipes or suggestions herein or hereafter.

10.4              We offer nutritional information for recipes on our website. Where possible we back up our statements and articles with scientific fact, studies or references. Varying factors such as product types or brands purchased can change the nutritional information in any given recipe. Other factors may change the nutritional information such as when salt or other ingredients are added “to taste” – this is not calculated into the recipe as the amount will vary.

10.5              To obtain the most accurate representation of the nutritional information in any given recipe, you should calculate the nutritional information with the actual ingredients used in your recipe. The client is solely responsible for ensuring that any nutritional information obtained is accurate.

10.6              Under no circumstances will James Toff or The Compound Club Ltd be responsible for any loss or damage resulting from your reliance on nutritional information given on the website.

11.                Liability and Disclaimer

11.1              The client accepts that participating in exercise has a risk of causing injury, both minor and potentially major and possibly death.

11.2              The client understands that the coaching services provided are not offered as a substitute for professional mental health or medical advice and are not intended to cure any health or medical conditions.

11.3              The client understands and agrees that they are fully responsible for their wellbeing during coaching sessions, and subsequently, including their choices and decisions.

11.4              The client understands that all comments and suggestions offered by the coach and The Compound Club Ltd are solely for the purpose of aiding them in achieving defined goals created with the coach.

11.5              The client hereby releases, waives, acquits and forever discharges the coach, any agents, successors, assigns, personal representatives, executors, heirs and employees from every claim, suit, action, demand or right to compensation for damages they may claim to have arising out of acts or omissions by the client or the coach as a result of the advice given by the coach or otherwise resulting from the coaching/training relationship.

12.                Miscellaneous

12.1              Amendment

(a)                 We may amend these terms and conditions from time to time without notice. All sessions, packages and purchases made from the date of the amended terms will be governed by those new terms. We will inform you if any new terms affect any current bookings you may have.

(b)                 These terms and conditions shall apply when you make a booking. They shall supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) whether oral or in writing. We advise that you print off and keep safe a copy of these terms and conditions.

(c)                 We advise that you read (and are responsible for reading) and understand all information fully.

(d)                 Any gestures of goodwill are purely that and will not form any part of any legal agreement.

12.2              Confidentiality

Personal information or business information supplied by clients will be treated as confidential. It will not be disclosed to a third party without the client’s prior permission, save where required by law or where action might be necessary to prevent harm to the client or someone else.
